Use of our Shapes and Sounds Pty Ltd website and all affiliated servers/websites/online spaces/programs/plug-ins (Site) is subject to and governed by the below terms and conditions (Terms of Use). By accessing our Site, you agree to the Terms of Use.

Content on this Site is provided for general information only. It is not intended as medical  advice, diagnosis or treatment. Such content should not be relied upon as a substitute for individual consultations with qualified health professionals who can determine your individual needs. We do not guarantee that you will be able to access to the Content of this Site (either directly or through third-party networks) at times or locations of your  choosing. Your access or use of this Site does not create in any way a practitioner/patient, confidential,  or privileged relationship, or any other relationship that would give rise to any duties on our  part. We are not liable to you or anyone else if interference with or damage to your computer or  other systems occurs in connection with your use of this Site, our workshop or programs. You  must take your own precautions to ensure that whatever you select for your use from this Site  is free of viruses or anything else (i.e. trojan horses) that may interfere with or damage the  operation of your computer systems. 

Your sole and exclusive remedy for any dispute with us is the cancellation of your subscription and discontinuation of use of the Site. We shall not be liable for any indirect, special, incidental,  consequential or exemplary damages arising from your use of or inability to use this Site.  

Upon a request by us, you agree to defend, indemnify, and hold harmless us, our employees,  contractors, officers, directors, agents, parent, other affiliated companies from all liabilities,  claims, and expenses, including legal fees, that arise from your use or misuse of the Site. 

Social Media and Postings 

This Site provides the ability for subscribed members to post comments ("Postings") and  engage in discussion that can be accessed and viewed by others, including the public in  general. Postings are not confidential. You may not post Postings that violate these Terms of  Use or other Posting Guidelines, and we reserve the right to block your ability to post and/or to access this Site if you do. 

We have no obligation to pre-screen Postings and are not responsible for their content. We  encourage you to notify us of inappropriate or illegal content. We reserve the right to remove  Postings for any reason. We are not, however, responsible for any failure or delay in removing  Postings.

We may collect personal information about you such as your name, your contact details, and  other information about you such as your age and health.  

Where reasonably possible, we seek to work with information and records from which personal  information has been removed. 

We use various systems and services to safeguard the personal information we store and use.  

We do our best to keep records of personal information up to date and accurate and not to keep personal information that is no longer needed. 

We sometimes have to pass on your personal information to third parties for legal or safety  reasons or other special circumstances. 

Workshops and Programs 

Bookings for any workshop or program as advertised on our Site or other platforms are confirmed by way of full payment, by debit or credit card, and receipt of a confirmation email  after purchase and registration for the workshop and/or program.  

The person responsible for and able to attend the workshop or program is the person named on the booking confirmation form.  

We cannot accept responsibility for any changes in personal circumstances or work  commitment. We reserve the right to cancel or change workshop dates if necessary, at any  time. In the event of cancellation, all customers will be notified. If a customer is not available  for the new date, they will be refunded the ticket in full and offered a choice of alternative dates for the workshop or program. 

Tickets for workshops or programs are non-refundable and non-transferable unless otherwise agreed at the sole discretion of Shapes and Sounds Pty Ltd. 

Subscription 

Subscription enables you to contribute to the interactive elements on this Site such as the discussion forums, live chat forums available from time to time, access to our weekly/monthly  articles and discounted rates for our workshops and programs. 

You can only log in and engage in discussions or make Postings under your own username  and credentials. We remind you that this Site is a public domain and you should not post or  disclose any information you are not comfortable or willing to share. If you are under 18 years  old, you should obtain the consent of your parent prior to subscribing and making any Postings. 

As a subscribed member and without limiting the activities which may be prohibited by law,  you must not engage in any conduct on this Site (including but not limited to the posting,  sharing or distribution of images, graphics, video, posts or any other content submitted by  another subscribed member) that: 

• is defamatory;
• constitutes a breach of copyright or another intellectual property right;
• makes a false or misleading representation or constitutes misleading or deceptive conduct;
• constitutes a breach of confidentiality or contract;
• contravenes any court order or constitutes a contempt Court of Parliament;

• is deliberately inaccurate, abusive, vulgar, hateful, obscene, profane, inappropriately sexually oriented, threatening or constitutes harassment;
• contains expletives or foul language; or
• incites or counsels any person to commit a criminal offence or constitutes a breach of public order.

We may terminate and/or suspend your subscription or registration for any workshop or  program immediately, without notice, if there has been a violation of these Terms of Use or  other policies and terms posted on the Site by someone using your subscription credentials.  We may also cancel or suspend your subscription or registration for any workshop or program  for any other reason but will attempt to notify you in advance of such cancellation or  suspension. 

Regardless of whether you subscribe, your use of this Site constitutes acknowledgement that  the views of subscribed members posting queries, comments or statements on this Site are  not necessarily our views and are not necessarily endorsed by us. 

If you have a complaint about any of the content that may be published on this Site, you should contact us. 

We may change these Terms of Use at any time, as we deem appropriate without notice to  you. You may take note of any change we make by noting on this Site that the Terms of Use  have been updated. If you disagree with the changes to these Terms of Use, discontinue your  use of the Site, or if you have subscribed as a member, you have to provide a written notice  to us.
